In this case, Plaintiff Soprema, Inc. (“Soprema”) claims that it incurred unpaid expenses for testing, supervision and inspection fees resulting from its efforts on a project in Hawaii. Soprema alleges that Defendants Beachside Roofing L.L.C. and Bodell Construction Company (“Bodell“) installed Soprema roofing products on four and six buildings respectively for the Queens’ MarketPlace project in Hawaii. In December 2006, Soprema began to notice leaks from the roofing work that it had not yet inspected. Soprema and Defendants agreed to mediate the repair issues at a mediation held in Hawaii and in March 2007, a settlement was reached.

In this lawsuit, Soprema alleges that Bodell and Beachside did not properly install the roofing system at the Queens’ MarketPlace project and failed to follow the protocol established at the mediation. The claim asserts that the alleged repairs were negotiated and conducted entirely in Hawaii, Soprema incurred unpaid expenses for the testing, supervision and inspection services in Hawaii and that the alleged agreement to remediate the faulty work was a contract within the jurisdiction of this Court.
